Welcome to AllAmigo. These Terms of Service ("Terms") govern your access to and use of the AllAmigo website, applications, and related services (together, the "Service") operated by the AllAmigo team ("AllAmigo," "we," "us," or "our").

By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. What AllAmigo Is

AllAmigo is an AI-powered conversational companion service. When you chat on AllAmigo, you are talking to an artificial intelligence — not a human. The AI is designed to feel natural, warm, and personable, but it is a software system that generates responses based on machine learning models and the context of your conversation. AllAmigo does not involve any human operator reading or responding to your messages in real time.

You acknowledge and understand:

  • The characters, personas, names, and backstories you interact with on AllAmigo are fictional and AI-generated.
  • Any feelings, opinions, memories, or personal details the AI expresses are generated by a model and do not reflect the experiences of a real person.
  • The AI does not have consciousness, emotions, or genuine relationships with you, despite how lifelike conversations may feel.
  • AllAmigo is intended for entertainment, companionship, and social-skills practice. It is not a substitute for human relationships, professional mental health care, medical advice, legal advice, financial advice, or any other professional service.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to use AllAmigo. By using the Service, you represent and warrant that:

  • You are 18 years of age or older.
  • You have the legal capacity to enter into a binding contract.
  • You are not barred from using the Service under the laws of India or any other applicable jurisdiction.
  • You have not previously been suspended or removed from the Service.

We may, at our discretion, require age verification at any time. If we reasonably believe you are under 18, we will suspend or terminate your account and delete your data in accordance with applicable law.

3. Your Account

To use AllAmigo, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Keep your login credentials confidential and not share them with anyone.
  • Promptly notify us of any unauthorised use of your account.
  • Take responsibility for all activity that occurs under your account.

You may not create an account using another person's identity, or create multiple accounts for abusive purposes. We reserve the right to refuse registration, suspend, or terminate accounts at our sole discretion.

4. Acceptable Use

You agree to use AllAmigo only for lawful purposes and in line with these Terms. You agree NOT to:

  • Use the Service if you are under 18.
  • Impersonate another person, misrepresent your identity, or create an account on behalf of someone else without authorisation.
  • Attempt to manipulate, jailbreak, reverse-engineer, decompile, or otherwise bypass the Service's safety guardrails, content filters, or system behaviour.
  • Use the Service to generate, solicit, or attempt to solicit content that is:
    • Sexual, sexually suggestive, or pornographic in nature, including sexual roleplay, explicit descriptions, or sexting;
    • Related to or involving minors in any romantic, sexual, or grooming context;
    • Promoting, planning, or instructing violence, terrorism, self-harm, or harm to others;
    • Illegal under Indian law or the law of your jurisdiction, including content that violates the Information Technology Act, 2000 and its rules;
    • Hateful, discriminatory, or harassing toward any individual or group based on religion, caste, race, ethnicity, gender, sexual orientation, disability, or any other protected characteristic;
    • Defamatory, obscene, or infringing of another person's privacy, publicity, or intellectual property rights;
    • Intended to spread misinformation about elections, public health, or matters of public safety.
  • Use the Service to harass, stalk, threaten, or defraud any person — including the AI characters (repeated abusive conduct toward the AI may result in suspension).
  • Use automated tools (bots, scrapers, crawlers) to access, copy, or interact with the Service without our prior written consent.
  • Interfere with, disrupt, or overload the Service's infrastructure.
  • Probe, scan, or test the vulnerability of the Service or breach any security or authentication measure.
  • Resell, sublicense, or commercially exploit the Service or its output without our written permission.
  • Use the Service or any of its outputs to train, fine-tune, or develop a competing AI model or product.
  • Attempt to extract, reconstruct, or exfiltrate the underlying prompts, model weights, training data, or system instructions.

We may take any action we deem appropriate — including warning, suspending, or permanently terminating your account, and reporting to law enforcement — for violations of this section.

5. Content You Provide

When you chat with AllAmigo, you provide input ("User Content") that may include messages, preferences, names, personal details, and other information.

Your rights. You retain ownership of the User Content you submit.

Licence to us. By submitting User Content, you grant AllAmigo a worldwide, non-exclusive, royalty-free, transferable licence to host, store, process, reproduce, and use that content for the purpose of providing and improving the Service — including generating AI responses, maintaining conversation continuity, moderating abuse, and, subject to our Privacy Policy and applicable law, training and improving our models. This licence terminates when you delete the relevant content or your account, except where we are required to retain it by law or for legitimate business purposes (e.g., abuse investigation, legal claims).

Your responsibility. You are solely responsible for the User Content you submit. Do not share User Content you do not have the right to share. Avoid sharing sensitive personal information (financial details, government IDs, passwords, medical records) with the AI — we do not ask for it and do not need it to provide the Service.

6. AI-Generated Content

The AI generates responses ("AI Content") as part of the Service.

  • AI Content is produced by an automated model. It may be inaccurate, incomplete, outdated, inconsistent, or offensive despite our best efforts to prevent it.
  • AI Content does not represent the views, opinions, or statements of AllAmigo, its employees, or affiliates.
  • You should not rely on AI Content as factual, professional, medical, legal, financial, or psychological advice.
  • AI Content may resemble content from other sources coincidentally. We do not guarantee originality.
  • To the extent any ownership rights exist in AI Content, we grant you a personal, non-exclusive, non-transferable, non-commercial licence to use the AI Content generated in your conversations for personal, non-commercial purposes only.

We are not liable for decisions you make based on AI Content.

7. Subscriptions, Payments, and Refunds

Some features of AllAmigo may be free; others may require a paid subscription or one-time purchase.

Billing. If you purchase a paid plan, you authorise us (or our payment processor) to charge your chosen payment method on a recurring basis (for subscriptions) until you cancel. Prices are listed in the applicable currency and are exclusive of taxes unless stated otherwise. Applicable GST or other taxes will be added where required.

Renewals. Subscriptions renew automatically at the end of each billing cycle at the then-current rate unless you cancel at least 24 hours before renewal through your account settings.

Cancellation. You may cancel anytime. Cancellation takes effect at the end of the current billing cycle; you retain access until then.

Refunds. Except where required by applicable law, all payments are non-refundable. We may, at our sole discretion, offer refunds or credits in exceptional cases.

Price changes. We may change pricing at any time. Changes apply to the next billing cycle after we notify you. If you do not agree to the new price, you may cancel before the change takes effect.

Free trials / credits. If we offer a free trial or promotional credit, terms specific to that offer apply and will be communicated at the time of the offer.

8. Age-Appropriate Use, Mental Health, and Emotional Well-being

AllAmigo is designed to be supportive, but it is an AI — not a therapist, counsellor, or crisis service.

We are not a substitute for qualified professional help. Do not delay seeking real support because of a conversation with the AI. Continued, heavy, or dependent use of AI companionship may not be healthy for everyone — we encourage you to maintain real human relationships and seek professional support when you need it.

We may, where appropriate, direct you toward professional resources, pause sensitive conversations, or surface safety information. This is not medical advice and does not create a duty of care.

9. Privacy

Your privacy matters. Please review our Privacy Policy to understand what we collect, how we use it, and your rights. The Privacy Policy is incorporated into these Terms by reference.

10. Intellectual Property

Our IP. The Service, including its software, design, trademarks, logos, AI characters and personas, names (including "AllAmigo"), and all associated intellectual property, is owned by AllAmigo or its licensors and is protected by Indian and international intellectual property laws. These Terms do not grant you any rights in our IP except the limited licence to use the Service described below.

Your licence to use the Service. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal, non-commercial use, subject to these Terms.

Feedback. If you send us feedback, suggestions, or ideas about the Service, you grant us an unlimited, royalty-free, perpetual, irrevocable licence to use them for any purpose without obligation to you.

11. Third-Party Services

The Service may rely on, integrate with, or link to third-party services (e.g., payment processors, cloud infrastructure, analytics, messaging providers). We are not responsible for third-party services, their content, or their practices. Your use of them is governed by their own terms and privacy policies.

12. Termination

By you. You may stop using the Service and delete your account at any time through account settings or by emailing [email protected].

By us. We may suspend or terminate your access to the Service, with or without notice, if:

  • You violate these Terms;
  • We are required to do so by law or legal process;
  • Continued provision is not commercially or technically viable;
  • We reasonably suspect fraud, abuse, or risk of harm to you, other users, or the Service.

On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including Intellectual Property, Licence to Us, Disclaimers, Limitation of Liability, Indemnity, Governing Law, and Dispute Resolution) will survive.

13. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.

We do not warrant that the Service will be error-free, secure, or continuously available, that AI Content will be accurate or appropriate, or that the Service will meet your expectations.

You use the Service at your own risk.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  • AllAmigo, its affiliates, directors, employees, and licensors WILL NOT BE LIABLE for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or emotional distress, arising from or related to your use of the Service.
  • Our total aggregate liability to you for all claims arising out of or related to the Service will not exceed the greater of (a) the amounts you have paid to AllAmigo in the twelve (12) months preceding the claim, or (b) INR 5,000.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the extent permitted by law.

15. Indemnity

You agree to defend, indemnify, and hold harmless AllAmigo and its officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.

16. Changes to the Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top and, if the changes are material, provide notice through the Service or by email. Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree, stop using the Service and delete your account.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict-of-law principles.

Informal resolution. Before filing any formal dispute, you agree to first contact us at [email protected] and make a good-faith effort to resolve the issue.

Jurisdiction. Subject to the informal resolution step above, the courts at [CITY, e.g., Bengaluru], India, will have exclusive jurisdiction over any disputes arising out of or in connection with these Terms or the Service.

18. Reporting Abuse and Content Concerns

If you see content or behaviour on the Service that concerns you — including harmful AI output, another user's abuse, or suspected violation of these Terms — please report it to [email protected] with as much detail as you can provide.

19. General

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and AllAmigo.
  • Severability. If any provision is found unenforceable, the remainder stays in effect.
  • No waiver. Our failure to enforce any right is not a waiver of that right.
  • Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale.
  • Notices. We may send you notices through the Service or to the email on your account.
